This is a question worth asking, which would have been the greater good. And obviously a lot that goes into it, so I can see both sides of him staying within the confines of the establishment or going rogue. I'm not really sure what the better option would have been.
reminder...my point here is that he would have been more useful going rogue and making cable news tours as a private citizen rather than the cute face guy over trump's left shoulder.

Moreover, police in many cases have a tenuous idea of what speech in this country is legal or not. For a recent example that got national attention, in 2019 police in Florida (of course it was Florida) arrested a Florida Man for disorderly conduct for having an "I eat ass" sign in the rear window of his truck. The problem with that is that 48 years previously in Cohen v. California the Supreme Court held that obscenities alone cannot be punished as disorderly conduct. I guess that wasn't long enough for police in Florida to get the message.

“One of the things officers are trained to do is to give warnings,” de Blasio said. “If someone has done something wrong, but not rising to a criminal level, it’s perfectly appropriate for an NYPD officer to talk to them to say, ‘that was not appropriate, and if you did that on a higher level, that would be a crime.’ I think that has an educating impact on people.”
