My kids were playing The Show last night and used the Live rosters game option...they played as the Pirates vs. Dodgers, naturally. They loaded the game rosters at the exact time Neil Walker PH for Cole, but started the game at the first inning...so Walker was the starting pitcher. 4 seam FBs all day baby.

As someone who has spent way over a thousand hours on a single game, I think the correct answer is "a little of both."The thing is, it's an Ultra Rare Trophy with only 1.5% of players obtaining it. That's pretty much it, minus two differences: 1) EA does not 'own' the rights to the names and likenesses of the players, they are licensed. 2) This is case of personality rights (which includes the right of publicity and the right of privacy), as distinct from 'intellectual property', which is (by definition) that which is created by the human intellect. When a person signs a league contract and becomes part of the player's association, part and parcel with that is signing over your publicity rights (as regards your name and likeness) to third parties for things like jerseys, apparel, video games, etc. That's all it includes. The 'skill set' is a creation by the developer (and likely assigned to the publisher) for the game, and is their intellectual property (the code for the game is copyrighted, and may be patentable.... but that last bit is an ongoing debate).

Totally tangential, but when Michael Jordon wasn't included in the NBA games in the '90s, was that because he wasn't part of the NBPA? I remember in some games he was represented by a guy on the Bulls who was just listed as "PLAYER" but had wicked attribute numbers.

Yeah he has been in the NBA2k series quite a bit, he was even on a cover a few years back. He is also in the game and on the cover of the special addition this year i believe.
