I went finch from a biological/taxonomical perspective. Dolphins are mammalian and penguins are avian.

A friend once asked me if penguins were seals, so I guess dolphin is the correct answer.

The closest relatives of the Sphenisciformes (penguins) are the Procellariiformes, which includes albatrosses and petrels.

A finch and a penguin would share a common evolutionary ancestor much more recently than a dolphin and a penguin.

1964's Rudolph the Red Nosed Reindeer established that a bird that swims instead of flies is, in fact, a misfit. Therefore, no matter where we think a penguin 'belongs', the birding community as a whole, not to mention effing Santa Claus, has rejected them as birds.

Do right by the little tuxedo wearing freaks...put them with the dolphins.
