LINCOLNTON, N.C. (WBTV) - New video obtained by WBTV shows deputies working at the Lincoln County courthouse restraining and trying to handcuff a 19-year-old who was having an apparent seizure.

Dayton Herman was alone in a hallway on the third floor of the Lincoln County courthouse on the morning of November 10 when, video shows, he became disoriented and fell to the floor. The video then shows him convulsing and then laying flat on the floor motionless.

A sheriff’s deputy enters the frame, sees Herman and appears to call for backup (the video does not have audio).

When a second deputy arrives, the pair try to put Herman in handcuffs, moving him to various places across the floor in the process.

A third deputy arrives and the three restrain Herman face down on the floor: one deputy sitting on his legs, another with a grasp on the back of Herman’s neck and the third over his back. He was placed in handcuffs and held that way until EMT’s arrived.

Discharge paperwork shows Herman suffered a broken wrist in addition to being treated for altered mental status and a seizure.
So deputies came across someone having a seizure and their first idea was to assault and handcuff that person, breaking his wrist.

Counter-protesters showed up, and there were scuffles that the police largely stayed out of. When the counter-protesters left, the "Back the Blue" folks realized that that the counter-protesters had slashed the tires on their cars and otherwise vandalized them, which was done right in front of dozens of cops who did nothing about it. Chicago police burst into the apartment of an innocent woman based on a faulty tip and handcuffed her while she was naked, forcing her to stand in full view of male officers as they searched her home, newly revealed body camera footage shows.

Local news outlet CBS 2, which has been investigating wrong-door raids by Chicago police for the past several years, first aired the footage of the 2019 incident last night, despite an attempt by the city of Chicago to block the TV station from running it.

"I feel like they didn't want us to have this video because they knew how bad it was," the woman in the footage, Anjanette Young, told CBS 2. "They knew they had done something wrong. They knew that the way they treated me was not right."

The body camera footage is part of a federal civil rights lawsuit filed by Young, who alleges the February 21, 2019 police raid traumatized her and violated her Fourth Amendment rights against unreasonable searches and seizures.

The video shows officers using a battering ram to enter Young's house, where she was in her bedroom changing. Young was handcuffed naked. One officer attempted to wrap a blanket around her, but because she was handcuffed, it kept slipping. She repeatedly told the officers that they had the wrong house. CBS 2 reports:

"OK, OK, you don't have to shout," the sergeant said.

"I don't have to shout?" Young yelled. "This is **** ridiculous. You've got me in handcuffs. I'm naked, and you kicked my house in. I keep telling you, you've got the wrong place."

Both Young and CBS 2 filed public records requests for the body camera footage, but Chicago refused to release it. The footage was only released to Young after a court order, which also included a confidentiality order.

This is not an isolated case. Young's case is just the latest in a long string of lawsuits filed against the Chicago Police Department for wrong-house raids.

Detective high on stolen fentanyl crashes police car while on duty, Oregon cops say

A former detective with the Klamath Falls police was arrested Tuesday, accused of causing a crash while on duty and allegedly high on drugs he stole from the department, according to a news release from Oregon State Police.

The multiple-vehicle crash took place on the evening of Nov. 27, the release said.

Thomas Dwayne Reif, 27, was driving a police car when the crash occurred.

Reif resigned from the department on Dec. 1, authorities told McClatchy News.

Before the crash, someone reported that Reif was “driving recklessly” on a 911 call, the release said. Personnel with Klamath County Fire District 1 responded to the crash and found Reif unresponsive and not breathing, according to the release.

Reif was transported to Sky Lake Medical Center where he was stabilized, the release said.

No other injuries were reported.

An investigation conducted by state police revealed “Reif had unlawfully obtained and used drug evidence from an unrelated case in the course of his duties,” according to the release.

Cop Runs Red Light With No Sirens or Lights, Plows Over 2 Bicyclists—Dept. Protects Him

San Francisco, CA — If the average citizen were to run a red light and plow into two bicyclists, rest assured that this person would, at the very least, be given a wide range of citations and possibly face arrest and jail time. But police officers aren’t average citizens and they instead belong to a club that grants them special privilege, protection from scrutiny, and apparently, the ability to plow down two bicyclists and escape immediate accountability.

Earlier this month, a yet to be identified San Francisco police officer blew through a red light and plowed into two bicyclists. The officer did not have on his lights, nor did he turn on his siren.

Luckily, both of the bicyclists lived, however, one of them was hospitalized.

This week, video and audio footage was released proving that the officer did not have on his sirens and lights and that the officer ran a red light. Yet nothing is being done.

Police haven’t responded to any questions in regard to the incident or what led up to the officer running the light and crashing into the two bicyclists. The only thing that was released, according to the San Francisco Chronicle, was a statement from Adam Lobsinger, a spokesman for the department, who said the cyclists struck the driver’s side of the patrol vehicle.

This one gets better. The lady (and her attorney) were on TV last night. The police conducted the search of her house after they ascertained they were at the wrong address. And in the article you linked, it says the mistake could have been avoided entirely if "police had done the bare minimum to vet the information on the search warrant"...... which apparently would've included loading up the suspect's actual physical location at that exact moment - down to like 1 or 2 meters - because he was wearing a GPS location monitoring device at the time pursuant to another matter.

Justice Department Finds Rampant Sexual Assaults and Constitutional Violations in Country's Largest Women's Prison

The largest women's prison in the country subjects incarcerated women to pervasive and frequent sexual assaults, violating their Eighth Amendment rights, the Justice Department concluded in a scathing and graphic report released today.

The report is the product of a two-year investigation by the Justice Department's Civil Rights Division into rampant sexual abuse and corruption at Lowell Correctional Institution, a state women's prison near Ocala, Florida, that holds about 2,200 inmates. Investigators found that "sexual abuse of women prisoners by Lowell corrections officers and staff is severe and prevalent throughout the prison."

"Incidents of staff sexual abuse of prisoners at Lowell are varied and disturbing," the report says. "Some staff abused prisoners through unwanted and coerced sexual contact, including sexual penetration, and groping. Prisoners were forced or coerced to perform fellatio on or touch the intimate body parts of staff. In other instances, staff demanded that prisoners undress in front of them, sometimes in exchange for basic necessities, such as toilet paper."

Furthermore, Justice Department investigators found that the prison had inadequate measures to prevent sexual abuse. Specifically, staff exploited blind spots in surveillance camera coverage to abuse women; the prison deterred women from reporting abuse via threats of retaliation and involuntary placement in solitary confinement "for days or weeks at a time;" and the Florida Department of Corrections (FDOC) Office of Investigator General (OIG) prematurely closed, suspended, or indefinitely delayed investigations into alleged sexual assaults, failing conduct proper investigations.

"A number of staff who allegedly sexually abused prisoners have been dismissed or resigned while under investigation, instead of being terminated for cause based on investigative findings," the report says. "In some of these instances, OIG terminated its investigation or failed to make progress investigating what may have been criminal misconduct."

Former O.C. sheriff’s deputy indicted after allegedly breaking into dead man’s home and stealing guns

A grand jury indicted a former Orange County sheriff’s deputy on burglary and gun theft charges months after he allegedly broke into a deceased man’s home several times, prosecutors said Tuesday.

Surveillance video revealed Steve Hortz, 42, forcing his way into the Yorba Linda home of a man he found dead during a welfare check in the summer, according to the Orange County District Attorney’s Office. He and two other deputies responded to the home located along Via Angelina Drive on July 20 and found the man had died from natural causes, prosecutors said.

Seven days later, Hortz broke into the man’s home while on duty and in uniform, according to prosecutors. He allegedly came back another two times — on Aug. 10 and Aug. 16 — shortly before he was scheduled to work. Prosecutors said he stole 15 firearms among other items.

Hortz, a resident of San Dimas, has been indicted on three felony counts of second-degree burglary and two felony counts of grand theft of a firearm, according to prosecutors.

He could face up to four years and four months in state prison if convicted of all charges.

“This act in and of itself has done so much damage to the public perception of law enforcement and the timing could not be more detrimental,” DA Todd Spitzer said in a written statement Tuesday.

Hortz’ next court appearance is scheduled for Jan. 26.

When announcing his arrest on Sept. 10, the O.C. Sheriff’s Department said Hortz was placed on paid leave after investigators discovered he stole items from the man’s home such as weapon safes and ceiling fans. A day earlier, an attorney representing the man’s estate had contacted sheriff’s officials.

“Yesterday was when the surveillance video was brought to our attention,” Carrie Braun, a spokeswoman for the department, said at the time.

The agency had been investigating the thefts for about a week but the lawyer showed officials video of Hortz breaking in, linking him to the thefts for the first time, she said.

On Sept. 30, Hortz resigned from the Sheriff’s Department rather than being fired, prosecutors said.

Following his arrest, sheriff’s officials said they were investigating whether the 12-year veteran deputy committed similar thefts and crimes while on duty.

Note that the cop wasn't fired even though the department's own investigators knew he had stolen the guns and he'd been arrested for the crimes. Instead, he was placed on paid leave. They knew he was a burglar and thief, and they were still paying him.

However, the two Keller police officers are still on the force, once again showing how dirty cops remain protected no matter how many lives they destroy or how many people they torture as they did to Marco Puente when they refused to give him a towel after they had pepper sprayed him for the non-crime of recording a traffic stop.

Now a 42-page lawsuit has been filed against the two cops, Blake Shimanek and Ankit Tomer, for violating the First, Fourth and 14th Amendment rights of both father and son. The incident took place on August 15, 2020 but the lawsuit was filed December 14. The body cam video was released Wednesday.

Shimanek, who initiated the unlawful arrest, was demoted from sergeant to officer after an internal investigation determined he arrested “an individual for an offense that was not committed" – which is supposed to makes us feel better even though he is still carrying a badge and a gun.

The other cop, Ankit Tomer, was already an officer, the lowest rank in the department, and faced no discipline for blindly following Shimanek's unlawful orders to arrest and pepper spray Puente who was only trying to protect his son from what he says was a traffic stop based on racial profiling.

A Black woman received $150,000 after alleging a police officer yanked her from a public restroom and forced her onto the sidewalk in handcuffs while investigating a reported theft.

A computer engineer, who is also Black, got $192,000 after officers — mistaking him for a robbery suspect — beat him so severely on his front lawn that he was hospitalized.

Five other Black men collected a total of $116,000 after suing the same officer for assault and violating their civil rights as he cleared sidewalks in a gentrifying neighborhood. In one case, a video showed the officer sitting on a man’s chest and showering him with pepper spray after punching him in the face six times.

Over the past five years, the D.C. government has spent millions of dollars settling dozens of police misconduct lawsuits — settlements that, even as officers acknowledge no wrongdoing, document a trail of nonfatal encounters that went painfully wrong.

These agreements draw little attention compared with settlements resulting from high-profile police shootings, such as the $12 million awarded to Breonna Taylor’s family in Louisville; or the $20 million Prince George’s County is paying to the family of a man whom police shot six times while handcuffed in a patrol car.

But they illustrate the types of altercations that sow distrust of law enforcement and feed perceptions that police are overly aggressive, particularly with Black Americans. Such grievances are a driving focus of the protests that began after the killing of George Floyd in Minneapolis police custody in May, fueling demands for reform nationwide.

This is a prime example of when I say that many, MANY, badge wearers are just bullies that realized that they can take their bullying to the next level because of the badge. I bet that if you ask high school classmates of Shimanek what kind of a guy he was they would say that he was a bully punk.

‘They Had The Guns Pointed At Me;’ Another Chicago Family Wrongly Raided, Just 1 Month After Police Created Policy To Stop Bad Raids

CHICAGO (CBS) — Guns with flashlights were the first things Sharon Lyons saw when the Chicago Police broke down her door.

It was 6:18 p.m. Just moments before, she was in the kitchen of her two-bedroom apartment in the Back of the Yards neighborhood.

“The next thing I knew, the whole panel to my door came flying down,” Sharon said.

Her 4-year-old granddaughter Lillie was sleeping in another room. Also home were her sons 32-year-old Timothy, 35-year-old James and 30-year-old Julius, who has autism.

Julius ran toward his mother in the kitchen when police burst in.

“Get down, get down, get down!” Julius remembered, describing how the officers shouted as police barreled through the door with guns drawn.

“They had the guns pointed at me, telling me to get down,” Sharon said. “I got down. I keep asking them, ‘What’s going on? Please tell me what’s going on.’ I’ve never been through nothing like this. They just kept saying they had a search warrant.”

As the family hit the floor, they heard Lillie’s screams from the bedroom, where she had been sleeping. She was alone, as officers began to search the apartment. The family said the raid team wouldn’t let them get to her.

“And I just heard [Lillie] start screaming,” James said, tearfully. “She was so helpless at the time, no one could help her.”

Sharon said she saw officers point guns toward Lillie as they entered the bedroom.

CBS 2 Investigator Dave Savini asked the 4-year-old if police pointed guns at anyone during the raid. She pointed to her grandmother and replied, “At her and me.”

It was Feb. 26 when police went before a judge and swore the information in their complaint for the search warrant was accurate. It was signed by an assistant state’s attorney at 2:37 p.m. Hours later, officers broke down Sharon’s door – the wrong door – looking for someone the family said they don’t know.

Just over a month earlier, in an interview, police officials committed to stopping bad raids like these from happening. Prompted by CBS 2’s ongoing investigation, the department changed its search warrant policy to ensure additional oversight with search warrant approval and more protections for children, like Lillie.

“We don’t want to see that happen,” said Lt. Matthew Cline in an interview with CBS 2 Investigator Dave Savini on Jan. 23. “We don’t want to erode the trust within the community.”

But it happened again – this time, to the Lyons.

Minnesota police officer Rod Webber told several Somalian-American teens he pulled over that they were being arrested because "I feel like arresting you," that he was a racist and "I’m proud of it," and that if the American military had "finished the job," then "you guys wouldn’t be over here right now." Webber also told the teens "“Do you remember what happened in Black Hawk Down when we killed a bunch of you folk? I’m proud of that." And why were the teens being pulled over in their blue Toyota Camry? Because the police were supposedly looking for a stolen blue Honda Civic. Even though it was the wrong car and the teens had proof ownership, that didn't stop Webber from handcuffing all four of them and making them wait for more than an hour while the cops searched their car and ran background checks on all four of them.



Webber is clearly a racist piece of garbage, and he was eventually fired, but not only did the police union fight for over a year to keep him on the force, but not a single other officer reported any of Webber's behavior even though he made those statements in the presence of other officers. Videos raise racial concerns about Jacksonville Sheriff’s Office interactions with public

On May 13 a Jacksonville officer parked his car in a driveway because he believed, according to an arrest report, the home was abandoned.

Williams, a 29-year-old graduate of the Paxon School for Advanced Studies and the University of Central Florida, walked out of her house and asked the officer if she could help him.

He said he was going to check emails and then leave shortly, according to the arrest report. The report said she then asked him to leave her property. He again said he was going to finish up his work there first.

“The suspect immediately threw a spoon with an unknown green substance on it at me while I was sitting in my car,” the report said.

She then called 911, asking for another officer to help her because he wouldn’t leave.

When another officer arrived, the first officer explained that she had committed battery by throwing a spoon at him.

The video shared on social media shows her pleading with the officers to leave her property.

“I want him to leave,” she told the officer. “... When I asked him, `Why are you here? Police officer, please leave,’ he started yelling at me. Do you think he has this kind of power, this kind of authority?”

She then repeats, “Why are you here, and why are y’all smirking?”

Then the video shows the second officer seeming to grab her as she runs backward into the house screaming.


Officer parks on private property and repeatedly refuses to leave when asked to leave. Instead, he attacks the homeowner, knocks her teeth out, and arrests her for resisting arrest and battery because she supposedly threw a spoon at him (which didn't hit anyone). He and other cops also searched her house without a warrant. The body cams demonstrate that the officer lied repeatedly about what happened and colluded with other officers to get his story "straight." Other cops also asked the officer if he had actually been parked there because "he was **** somebody" and commented that "I heard that black ***** was really fat." WASHINGTON (AP) — The Justice Department announced Tuesday that it would not bring federal criminal charges against two Cleveland police officers in the 2014 killing of 12-year-old Tamir Rice, saying video of the shooting was of too poor a quality for prosecutors to conclusively establish what had happened.

A Bexar County Sheriff's deputy has been arrested for the second time this year on suspicion of physically assaulting his girlfriend, Sheriff Javier Salazar announced during a news conference Monday.

John Paul Garza, 31, was charged with continuous violence against family and violation of a protective order. He was arrested early Monday morning.

Salazar said deputies were called to a San Antonio residence Sunday evening after the victim told police that Garza knocked her down onto the ground and began kicking her in the face. During the assault, her clothes became soiled with blood and Garza began to forcibly remove her clothing in an attempt to destroy the evidence, the sheriff said.

The woman ran to a neighbor's home to call for help. Garza fled the scene but was arrested several hours later.

The sheriff said Sunday's assault reads like a "carbon copy" to the previous assault on the same victim in February.

According to Salazar, the termination process was underway after the first incident, and Garza has been on unpaid administrative leave for the past 10 months. When asked why Garza was still employed with BCSO, Salazar said the internal affairs process is slow and rests too heavily on the criminal proceedings before decisions are made.

"I would love to be able to terminate deputies like him on the spot, but due process needs to occur," Salazar said, adding Garza will receive a second termination dismissal.

Garza has also received prior disciplinary action from the department, serving a 10-day suspension in 2013 for inappropriate force on an inmate. During the incident, Salazar said the inmate retaliated and assaulted Garza, who later lied on a polygraph test about what occurred.

It's not "due process" that makes it nearly impossible to fire rotten cops. It's police unions.

Bodycam Video Shows ‘Mob Mentality’ Of Boston Police Who Responded To George Floyd Protests, Lawyer Says

As demonstrations against police brutality and abuse of Black Americans spread across Boston on the night of May 31 and early morning of June 1, the city’s police department was out in force.

Many officers wore body cameras. During the unrest, the cameras recorded hours of footage that the department subsequently stored.

That footage was given to attorney Carl Williams, who is representing some protesters arrested that night, as part of a discovery file encompassing 44 videos and over 66 hours of footage. Williams assembled a team of volunteer lawyers and law students to pore over the videos to find exculpatory evidence for his clients. What they found, however, was something more.

The hours of video, given exclusively to The Appeal by Williams, show police officers bragging about attacking protesters, targeting nonviolent demonstrators for violence and possible arrest, discussing arrest quotas and the use of cars as weapons, and multiple instances of excessive force and liberal use of pepper spray.

“It’s this mob mentality,” Williams said of the police behavior. “And I use ‘mob’ as a sort of a double entendre—mob like the mafia and mob like a group of a pack of wild people roaming the streets looking to attack people.”

The Appeal shared sections of the footage with Suffolk County District Attorney Rachael Rollins, who said that in her view, police behavior in the videos is indicative of the very issues that demonstrators were marching to bring attention to.

“I have not watched the entire video, but the snippets that I have seen are incredibly troubling,” said Rollins, adding that she has sent the clips to her special prosecution team.
Examples:
The officers appear enthusiastic about using the chemical weapon and unconcerned with whether to arrest demonstrators. In one clip, timed at 1:52 a.m., officers advancing on a crowd are pushing one young man standing with his hands raised.

“We gotta start spraying more,” the officer wearing camera X81417350 says.

“You out?” he asks another police officer offscreen, holding up a can of pepper spray. “I got a little left.”

“I want to hit this dadhole,” he says, gesturing toward the young man being pushed back. “I’ve used two of these already—I’ve got a little left, I want to hit this kid.”
The officers also appear to target certain demonstrators for violence. In one clip from 1:26 a.m. near the Common, a group of officers on bikes react strongly when a demonstrator kicks a tear gas canister back at them.

“Let’s get this ****,” says the officer behind camera X8141668. “Let’s get him, lock him up.”
In another clip, a sergeant approaches the officer behind camera X81331058 and begins telling him about using a police vehicle to attack demonstrators.

“Dude, dude, dude, I ****’ drove down Tremont—there was an unmarked state police cruiser they were all gathered around,” says the sergeant, laughing.

“So then I had a **** keep coming, **** running,” he continues. “I’m **** hitting people with the car, did you hear me, I was like, ‘get the ****—'”

At this point the officer behind the camera pushes the sergeant’s head away and walks off in the other direction. He comes back a few seconds later, saying, “it’s on,” about the camera.

The sergeant quickly changes his story.

“Oh, no no no no no, what I’m saying is, though, that they were in front, like, I didn’t hit anybody, like, just driving, that’s all,” he says. “My windows were closed, the **** was coming in.”

The Boston police sergeant mired in recent controversy over video footage showing him bragging about intentionally striking protesters with his vehicle is a veteran supervisor with a troubled, complicated past on the police force, according to two people briefed on the matter.

Clifton McHale, a 23-year Boston Police Department veteran with family ties to the department’s upper ranks, was accused in 2005 of sexually assaulting an intoxicated woman while in uniform in a police vehicle and agreed to serve a one-year, unpaid suspension following an investigation.

McHale hasn’t been publicly identified by police or city officials. But two people briefed on the matter identified him as the sergeant in the now-viral video, laughingly telling a colleague that he drove into protesters on a chaotic night in downtown Boston.

PITCAIRN (KDKA) — A local police detective has turned himself in to face charges after investigators say he pulled out his gun during a New Year’s Eve party and stuck it in another man’s side.

Police say North Braddock Police Detective Craig Gibson surrendered to officers in Pitcairn. Gibson is being held in the Allegheny County Jail while awaiting arraignment.

According to the criminal complaint, witnesses told police that Gibson appeared intoxicated when he showed up, uninvited, to a party on Thursday night. Police say he was with a friend.

The criminal complaint reports four witnesses said Gibson had his badge visible and was wearing his gun on his hip.

“An off-duty police officer brandishing a gun and having his badge, actually poking people with the gun out of his holster,” said Pitcairn Police Chief Scott Farally.

Police say people at the party asked him to put his gun and badge away, “because it was unnecessary,” and that’s when investigators say Gibson pulled out the weapon and pushed it against a man’s side.

“He actually took the gun out of its holster and put it on the ribs of other individuals,” said Farally.

Gibson, of McKeesport, is facing charges of terroristic threats, simple assault, harassment and reckless endangerment.
