So not for the Musk thread - but I've been thinking about this. How does a guy who leads the head of a major U.S. defense contractor get to say Joe Biden is committing Treason on X? Especially if he's meeting with Trump to be a donor? Thing seems awfully murkey there, yea?

No, because we have free speech and free association in this country, and First Amendment retaliation is illegal. Under Board of Comm'rs, Wabaunsee Cty. v. Umbehr, 518 U.S. 668 (1996) and O'Hare Truck Service, Inc. v. City of Northlake, 518 U.S. 712 (1996), it is illegal for the government to either: (1) terminate or refuse to renew a government contract in retaliation for an independent government contractor's exercise of the freedom of speech; or (2) retaliate against a contractor or a provider of services for the exercise of rights of political association or the expression of political allegiance, which includes campaigning against the reelection of a government official and/or supporting the political opponent of a government official.

In other words, if the fedgov terminates SpaceX as a contractor based on what Elon Musk says about Joe Biden, or who Elon Musk associates with, or who Elon may choose to donate to or to support or not support in an election, Elon would get even richer because SpaceX would sue the fedgov and win.

So let me get this straight.

We're okay with the government officials taking bribes, but we're not okay with government action as a result of a bribe?

So like, sure do all the bribing and favoritism you want, but you may absolutely not have your precious government contracts terminated for bribing the opponent.
