Why are neither of them being charged with attempted murder?Nicholas was charged with one count of first-degree assault and armed criminal action. Joseph was charged with one count of unlawful use of a weapon.

My only thought (hope?) is that these are just sort of 'entry level' charges to get each suspect booked and into the CJS. Because with five people (four minors) in the car downrange, there are a lot of other charges that can be piled on there. I mean, a lot.

He got charged under MO code 565.050 Assault, first degree...
A cursory glance at Missouri state law didn't immediately find an "attempted murder" provision...565.050. 1. A person commits the crime of assault in the first degree if he attempts to kill or knowingly causes or attempts to cause serious physical injury to another person.
2. Assault in the first degree is a class B felony unless in the course thereof the actor inflicts serious physical injury on the victim in which case it is a class A felony.

Boxer Patrick Day dies after suffering traumatic brain injury in super welterweight fight
Boxer Patrick Day died Wednesday after suffering a traumatic brain injury Saturday night during a bout in Chicago. He was 27.
Day was hospitalized and in "extremely critical condition" Saturday night after he was knocked out by Charles Conwell in the 10th round of their USBA super welterweight title fight. Day was taken to Northwestern Memorial Hospital and underwent emergency surgery. He lapsed into a coma and never regained consciousness.
