If citizens lied on the witness stand, they could be prosecuted for perjury. And if they lied in their work reports, they could be fired. But police officers don’t always face that fate.

The practice of police officers fudging the facts is common enough that it even has a name — “testilying” — and it has plagued the Boston Police Department for decades. In the ’90s, Commissioner William F. Bratton called it a significant problem that merited attention and training, much to the chagrin of the rank and file. More than a decade later, Commissioner Edward F. Davis took it one step further, declaring that any officer who lied would be fired. The department followed through in a handful of instances, but hardly in all the cases brought to its attention.

Today, some officers continue to struggle with telling the truth, whether in court or everyday police matters, and BPD has no mechanism to monitor officer testimony or truthfulness. Quite often, records show, internal affairs investigators are reluctant to call a lie a lie.

Officer pleads guilty in unprovoked pepper spraying, can no longer be a cop

As part of his plea deal, Ryan Dubiel, 32, of Wenonah, was sentenced to one year of probation, was prohibited from having contact with the man and teen, and, “must abide by any additional terms deemed appropriate by probation,” according to a statement from the Camden County Prosecutor’s Office.

Dubiel also agreed to forfeit his position at the department and was prohibited from holding any public office in New Jersey, including working as a police officer, the office said.

“On June 4, 2020 at 1:30 p.m., video footage showed that at the time of the OC spray deployment, the individuals were not observed physically resisting or attempting to harm others or themselves,” the prosecutor’s office said in a previous statement, using an abbreviation of oleoresin capsicum, an oily extract from pepper.

On Thursday, the office called his use of the spray, “not consistent with the State of New Jersey use-of-force policy.”

Body cam footage showed Dubiel running after two suspects while unleashing pepper spray.

He was suspended without pay after videos of the incident surfaced on social media and charged on June 10 with two counts of simple assault after the office said it “carefully and impartially review(ed) evidence.”

“With this resolution, there is a guarantee to the public that this individual will not serve in any position of public trust in Camden County or anywhere else in the state,” Acting Camden County Prosecutor Jill S. Mayer said in a statement. “We hope this serves as a reminder that no one is above the law and we take all accusations and abuse of power seriously.”

Dubiel served as a Woodlynne officer for 10 months, marking the ninth police department where he worked, according to officials.
Note that this 32-year-old cop was working for his ninth police department. I highly doubt this was his first incident of using unlawful force.

New York State Attorney General Letitia James sued the New York City Police Department on Thursday, alleging widespread abuses in the response to protests over police brutality and systemic racism last summer in the wake of George Floyd’s death.

Citing “a pattern of using excessive force and making false arrests against New Yorkers during peaceful protests,” James said the lawsuit “specifically charges the NYPD, the City of New York, Mayor Bill de Blasio, NYPD Commissioner Dermot Shea, and NYPD Chief of Department Terence Monahan with failing to address this longstanding pattern of abuse by not properly training, supervising, and disciplining officers to prevent misconduct, despite knowledge and public admission that it violated the rights of New Yorkers.”

The lawsuit comes following an investigation by James’s office into aggressive police tactics seen this summer, including the beating of demonstrators with batons and bicycles; the arrests of legal observers and medics; and a crowd-control strategy known as kettling, in which officers confine a large group of protesters in a small area to restrict their movement and make arrests. In one notable instance, the NYPD trapped thousands of protesters on the Manhattan Bridge for hours, a tactic defended by Mayor de Blasio and Commissioner Shea.

“There was ample ability and opportunity for the city and NYPD leadership to make important changes to the way that officers interact with peaceful protesters, but time and time again, they did not,” James added. “They did not train, they did not supervise, they did not stop officers who engaged in this misconduct. And they did not discipline them either. Instead, they failed the people of the City of New York.”

Special Agents from the Tennessee Bureau of Investigation (TBI) and Dickson Police Department on Friday arrested a man accused of posting a fake photograph on social media depicting two men urinating on the grave of a police officer who was tragically killed on duty in 2018. The arrest, and subsequent bond demanded for his release, outraged attorneys who were quick to point out that despite being horrifically insensitive, the doctored photo in question is undoubtedly protected under the First Amendment of the U.S. Constitution.

Butthurt cops didn't like a meme, so they arrested a man in flagrant violation of the First Amendment.

Another Houston Cop Is Indicted for Murder Because of a 2019 Drug Raid That Killed a Middle-Aged Couple

A second Houston narcotics officer has been charged with murder in connection with the January 2019 no-knock drug raid that killed Dennis Tuttle and Rhogena Nicholas in their home on Harding Street. Harris County District Attorney Kim Ogg yesterday announced that a grand jury had indicted Officer Felipe Gallegos for murdering Tuttle, who according to police fired at the cops after they broke into his home and killed his dog while serving a search warrant based on a heroin deal that never happened. Gallegos faces a maximum penalty of life in prison if convicted.

Gerald Goines, the former narcotics officer who lied to obtain the search warrant, already had been charged with two counts of felony murder as well as federal civil rights violations. Steven Bryant, an officer who backed up Goines' phony story, likewise faces state and federal charges. Prosecutors say Goines' shady practices go back more than a decade, tainting at least 164 convictions.

The new indictments also include eight current or former narcotics officers who are accused of "engaging in organized criminal activity" by falsifying government records as part of "a long-term scheme to steal overtime from the city." Five were charged with first-degree felonies that carry a maximum penalty of life in prison, while three were charged with second-degree felonies punishable by prison terms of two to 20 years.

So far 12 current or former narcotics officers have been charged as a result of the investigation triggered by the Harding Street raid. "The consequences of corruption are that two innocent people and their dog were shot to death in their home by police; four officers were shot, one paralyzed," Ogg said. "Now all of them will face jurors who will determine their fate."

And the cops and city are still trying to cover this up:
Two years later, the HPD still has not publicly said how many shots were fired or which rounds struck the injured officers. The Houston Chronicle notes that "neither Acevedo nor Ogg has ever released the ballistics report showing which officers shot Tuttle or Nicholas."

Nicholas' mother and brother have been trying to discover exactly what happened during the raid, which was not recorded by body cameras. Their lawyer, Michael Doyle, is seeking to depose city and HPD officials. The city has resisted him at every turn. The Texas Supreme Court has twice rejected the city's attempts to move the case out of Harris County Probate Court. A few weeks ago, Judge Kenneth Hoyt of the U.S. District Court for the Southern District of Texas agreed that the case belongs where it is.

'She Could Have Been Hurt Worse': Police Union Defends Officer Who Pepper-Sprayed 9-Year-Old Girl

The police union in Rochester, New York, is defending a group of cops who pepper-sprayed and handcuffed a nine-year-old girl on Friday.

"They were trying to get her into the car," said Mike Mazzeo, president of the Locust Club police union, at a press conference. The officer who pepper-sprayed the girl "made a decision there that he thought was the best action to take," Mazzeo declared. "It resulted in no injury to her. Had they had to go and push further and use more force, there's a good chance she could have been hurt worse. It's very difficult to get someone into the back of a police car like that."

In this case, that someone was a child—what's more, a child who wasn't suspected of committing any crime. Footage shows her screaming for her father as officers force her to the ground to cuff her. The police were reportedly responding to a family disturbance call, with Deputy Police Chief Andre Anderson claiming that the child "indicated that she wanted to kill herself, and she wanted to kill her mom," according to The New York Times.

Prior to that, she can be seen running down the street away from an officer on the scene.

He eventually caught up. "You're not gonna run away from me, OK?" an officer says. "Because I'm gonna have to chase you, OK? And I got, like, six other cars coming to chase you."

"I'm scared," the girl replies as she cries. The officer ultimately delivered on his promise, with the video footage showing at least six squad cars and seven cops, all to detain a nine-year-old.

The union's reaction shouldn't be particularly surprising. Public-sector unions exist to protect their members at all costs. That is, after all, the purpose of a union. Those of the public-sector variety have the advantage of monopoly control.

A Los Angeles police officer has been charged with stealing a truck from a dealership in Orange and driving the stolen pickup more than a year after changing its status to recovered, prosecutors said Monday.

Matthew Calleros, a 45-year-old Whittier resident, pleaded not guilty Monday to the three felonies and three misdemeanors he’s facing. They include unlawful taking of a vehicle, forging a license plate, false personation and unauthorized disclosure of information from state DMV records, the Orange County District Attorney’s Office said in a news release.

Calleros allegedly went to B&J Car Co. on Chapman Avenue on Oct. 25, 2019, and drove a 2015 Chevy Silverado off the lot after asking a salesman to pull a Carfax report on the truck.

Gino Gonzalez, a sales manager at the used car lot, told KTLA last November that he remembered Calleros coming in and walking straight to the Silverado, seeming very interested.

Gonzalez says he showed Calleros around the truck, opening the hood and starting the engine. He walked to his office after being asked for the Carfax report, and heard the hood shut before he got to his office door.

“I turned around and he was already climbing into the truck, and he proceeded to drive off,” Gonzalez said.

Surveillance video from the dealership shows Gonzalez running after the truck as it was driven away.

After stealing the truck, Calleros used another L.A. police officer’s ID to call his department’s Vehicle Warrant Unit to report the pickup had been recovered, prosecutors said.

Officials also allege he accessed the California Law Enforcement Telecommunications System (CLETS), a confidential database connecting public safety agencies statewide, to run checks on his stolen truck’s license plate number and a plate number for a 2014 Silverado that he put on the stolen pickup.

Prosecutors say Calleros drove the stolen vehicle for more than a year, including to work as a police officer. The pickup was found in the employee parking lot at LAPD’s Hollenbeck Division when Calleros was arrested last year on Nov. 9.

The Pennsylvania State Police (PSP) announced today the arrest of Trooper Robert E. Covington Jr., of Olyphant, PA, for his alleged involvement in illegal activity occurring at Sinners Swing Gentlemen’s Club in Mayfield Borough, Lackawanna County. Covington, 48, is a 13-year veteran of PSP and was assigned to the Bureau of Gaming Enforcement, Pocono Downs Wilkes-Barre Office. He had been on restricted duty during the investigation and is currently suspended without pay pending resolution of the charges against him.
In November 2018, the PSP Bureau of Criminal Investigation received information from PSP Troop R that David Klem and his business partner, an active-duty member of PSP later identified as Covington, owned and operated Sinners Swing Gentlemen’s Club. Initial allegations indicated the club was being used to promote illicit activity.

Investigators developed and presented evidence to the statewide investigating grand jury alleging Covington, Klem, and others were operating a corrupt organization involving prostitution, gambling, and money laundering.

A former Waynesboro police officer sent sexually explicit messages to and then molested a 15-year-old girl he met when he answered a call about her attempted suicide, state police contend.

Some of that illicit contact occurred while William E. Sublett IV was supposed to be on duty, Trooper Erica Polcha said in an affidavit with Sublett’s arrest on charges including indecent assault, corruption of minors and aggravated indecent assault.

Polcha wrote that investigation of Sublett, 33, of Washington Township, began on Dec. 10 when the girl reported the alleged abuse to her guidance counselor at Waynesboro High School.

The girl said she met Sublett during the December 2019 suicide attempt call, that he had online sexual conversations with her, has asked for unclothed photos of her and had fondled her breasts and genitals against her will at his home this past November, the trooper wrote.

CLEVELAND, Ohio — A new body camera video released by Cleveland officials on Tuesday showed a fired city police officer using his stun gun on a man who stood on the sidewalk yelling at officers.

The video is the second of three released showing the pattern of excessive force that led to former officer John Petkac’s December firing. Petkac wrote in his report that he used his stun gun during the July 24, 2019 encounter because the man was “armed with” a jug of antifreeze.

Cleveland Safety Director Karrie Howard wrote in his letter notifying Petkac of his firing that he found the officer used excessive force, improperly used his stun gun, failed to use de-escalation tactics and failed to report his use of force accurately.

The city has yet to release its complete internal affairs investigation to the public and has said there is a third video that it declined to release as of Wednesday afternoon. A video police released last week showed a separate incident where Petkack with his foot on a criminal suspect’s throat.

The most recent video shows Petkac drove to help another officer arrest a man along Payne Avenue and East 22nd Street.

Within seconds of getting out of his car, Payne shouted at two men standing on the side of the street and threatened to arrest them.

“Get lost, or your going to come with us,” Petkac said.

Petkac then yelled at Maurice Lewis.

“Go back to 2100,” Petkac said, referencing the nearby homeless shelter. “Go back to 2100, and I’ll go back to my community.”

Another officer walked up to Lewis in the middle of the street but eventually walked away. Petkac continued to demand that Lewis leave.

Lewis can be heard shouting back, sometimes using obscenities, but it’s unclear from the video exactly what he said.

Petkac put the arrested person in his cruiser and walked up to Lewis, who took a few steps toward the officer. Lewis pulled out his stun gun.

Petkac again yelled at Lewis to “get the hell out of here.”

Lewis didn’t move. Petkac pushed Lewis with his other hand. Lewis said, “Don’t touch me.”

Petkac told Lewis again he’d use his stun gun if he took another step. Lewis again didn’t move and told Petkac: “You’re trying to set me up, b----h.”

Before Lewis finished his sentence, Petkac fired the stun gun into Lewis’ chest. Lewis dropped to the ground. Petkac and the other officer grabbed his arm and rolled him over.

“What did y’all do to me?” Lewis said. “I didn’t do nothing.”

Petkac wrote in his report of the incident that he knew Lewis from previous incidents involving drug use and “violent behavior.” He wrote that he tried to de-escalate the situation but that Lewis walked up to him with two other men. The video showed two men standing behind Lewis, but they appeared to be watching the interaction.

Petkac wrote that he became fearful because Lewis appeared intoxicated and was “armed with a large yellow container” that turned out to be a jug of antifreeze. Petkac also wrote that Lewis raised the bottle “in a swinging manner” that made Petkac believe Lewis was about to attack him. Petkac’s report said that’s when he fired his stun gun.

CHARLOTTE COUNTY, FLORIDA: Marty Allen, a Charlotte County deputy, was arrested on Sunday, February 14 on charges of lewd conduct after he allegedly tried to acquire nude photos from an undercover cop who he thought was a 15-year-old girl. According to authorities, the said undercover agent spoke to Allen for ten months and the 41-year-old is now facing criminal charges. According to news station WBBH, two undercover agents said the conversations between Allen and the teen they pretended to be would occur while he was on duty.

Elijah McClain death: Aurora police didn’t have legal basis to stop, frisk or choke 23-year-old, investigation finds

Elijah McClain was a 23-year-old black massage therapist from Aurora, Colorado, who died after being placed in a chokehold by police and being sedated with ketamine (the "date rape" drug) by paramedics. On August 24, 2019, an Aurora citizen reported to police that McClain was wearing a ski mask and looked "sketchy", although the caller also indicated that he did not believe anyone was in danger, and that he believed McClain was unarmed. The Aurora police approached, detained, tackled, and handcuffed McClain and then choked him. Paramedics arrived and forcibly sedated McClain, which is something the Aurora police and officials apparently have a practice of doing. McClain went into cardiac arrest and died. The police were not charged by the District Attorney, and an internal investigation cleared them. The city council, however, ordered and independent investigation, and the findings are damning:
Aurora police and paramedics made substantial errors at nearly every stage of their interaction with Elijah McClain and the detectives tasked with investigating the incident that led to the 23-year-old’s death stretched the truth to exonerate the officers involved, an independent investigation found.

Aurora police officers did not have a legal basis to force McClain to stop walking, to frisk him or to use a chokehold on him, according to the investigation commissioned by the city released on Monday.

Paramedics with the city’s fire department failed to properly evaluate McClain—or even attempt to speak to him—before injecting him with a powerful sedative.

And the detectives assigned to scrutinize what happened that night “failed to meaningfully investigate” the incident, the report states.

The report from the detectives was relied upon by the department’s force review board as well as the 17th Judicial District Attorney’s Office, both of which cleared the officers of wrongdoing.

“The body worn camera audio, limited video, and Major Crimes’ interviews with the officers tell two contrasting stories,” the independent report states. “The officers’ statements on the scene and in subsequent recorded interviews suggest a violent and relentless struggle. The limited video, and the audio from the body worn cameras, reveal Mr. McClain surrounded by officers, all larger than he, crying out in pain, apologizing, explaining himself, and pleading with the officers.”

“It is hard to imagine any other persons involved in a fatal incident being interviewed as these officers were,” the report continues.

So the cops didn't have any grounds to detain McClain in the first place, they lied about what happened, they were treated with kid gloves, and the subsequent internal investigation was rigged to clear them—not determine the truth.

According to the report, the investigation of the incident by the Aurora Police Department's Major Crime/Homicide Unit "raised serious concerns" and "revealed significant weaknesses in the Department's accountability systems." During their interviews, detectives "failed to ask basic, critical questions about the justification for the use of force necessary for any prosecutor to make a determination about whether the use of force was legally justified." The questions "frequently appeared designed to elicit specific exonerating 'magic language' found in court rulings." The investigators' report, on which both the district attorney and the police department's Force Review Board relied, "failed to present a neutral, objective version of the facts and seemingly ignored contrary evidence."

Unsurprisingly, the Force Review Board's examination of the incident was "cursory and summary at best." The case "was never referred to Internal Affairs investigators," which would have required the police chief's approval. That policy, the panel's report says, "places the Chief in a difficult and potentially compromised role, and limits the independence of Internal Affairs to investigate potential failures to comply with Department policy."

The panel recommends several steps to "lessen the chance of another tragedy like this one." They include better training and supervision, a review of the department's policies regarding de-escalation and the use of force, improved cooperation between police and emergency medical personnel, a reexamination of sedation practices, and "an overhaul of the post-incident review process."

This report reveals that Aurora police officers either do not understand the constitutional constraints on their behavior or cannot be bothered to comply with them. That goes for the remarkably incurious detectives who investigated the incident as well as the officers who illegally detained and assaulted McClain.

A Louisiana state police trooper has been suspended without pay for kicking and dragging a handcuffed Black man whose in-custody death remains unexplained and the subject of a federal civil rights investigation.

Body camera footage shows Kory York dragging Ronald Greene “on his stomach by the leg shackles” following a violent arrest and high-speed pursuit, according to internal state police records obtained by the Associated Press.

The records are the first public acknowledgement by state police that Greene was mistreated. They confirm details provided last year by an attorney for Greene’s family who viewed graphic body camera footage of the May 2019 arrest and likened it to the police killing of George Floyd, whose death last year triggered widespread protests and a national reckoning with police brutality and systemic racism.

The video shows troopers choking and beating the man, repeatedly jolting him with stun guns and dragging him face-down across the pavement, the attorney told AP.

State police have repeatedly refused to publicly release the body camera footage. The agency has been tight-lipped about Greene’s death and initially blamed the man’s fatal injuries on a car crash outside Monroe, Louisiana.

York, who turned his own body camera off on his way to the scene, is seen on other body-cam footage yanking Greene’s shackles and repeatedly using profanity toward Greene before he died in custody.

York was suspended without pay for 50 hours following an internal investigation that also led to the termination of another trooper, Chris Hollingsworth, who died in a single-car crash after learning he had been fired over his role in the incident.

The AP last year published a 27-second audio clip from Hollingsworth’s body camera in which he can be heard telling a colleague: “I beat the ever-living **** out of” Greene before he “all of a sudden he just went limp”.

“It is now undisputed that Trooper York participated in the brutal assault that took Ronald Greene’s life,” said Mark Maguire, a Philadelphia civil rights attorney who represents Greene’s family. “This suspension is a start but it does not come close to the full transparency and accountability the family continues to seek.”

Lamar Davis, who took over as state police superintendent last year, wrote York that his suspension had been decided by his predecessor, Kevin Reeves, adding he “would have imposed more severe discipline” had it been up to him.

York told investigators he turned his own body-worn camera off because it was beeping loudly and that his “mind was on other things” after arriving at the scene.
