I'd have been interested to see what would have happened right now had the tables been turned... GOP in control of house, senate, and whitehouse and they had legislature they wanted to pass. I can all but guarantee there'd be none of this hemming and hawing over eliminating/modifying the filibuster. It would have been gone within a week of them all getting sworn in.

The idea that it takes more votes to end debate on a measure than to pass it is just silly. Make the cloture threshold 40 votes and reinstate the talking filibuster and call it a day.

YepSo would you be ok with the government sending out covid information via text as long as it’s not a direct response to a monitored message?Seems like we're overcomplicating it. Misinformation is not new. I'm a proponent of sharing educating material however possible, and what people do with it is their prerogative.

Most likely. There's an open constitutional controversy over what is commonly called the "third party doctrine." Back in the 1970s the SCOTUS held that people who voluntarily give information to third parties—such as banks and phone companies—have no expectation of privacy in that information, which means that Fourth Amendment protections either apply less or don't apply. But those decisions are somewhat out of date when it comes to modern concepts like cloud computing, text messaging, email, etc., and the SCOTUS really hasn't directly addressed the scope of the doctrine when it comes to modern tech. The government, of course, would want to argue that the third-party doctrine applies broadly because that would let the government go to Google, Verizon, Amazon Web Services, etc. and gain access to customers' information without warrants.

In Apple's case it may have been more of a security concern on their part. They're notorious for emphasis on security. I'd like to think these companies would want to protect their bottom line and customer interests but not exactly like consumers would have many places to go otherwise.

I didn't quite word that how I wanted but sort of what I meant by most users wouldn't really have much of a choice to go elsewhere for these services. However it'd probably be easier for the government to go to smaller services since most apps require the user to give access to contacts, text, photos, etc.
