Rare bit of good news. The incoming administration is nominating FTC commissioner Rohit Chopra to head the Consumer Financial Protection Bureau (CFPB). He is a **** stud; he just gets it. He is the only FTC commissioner that I follow on Twitter.

He first came on my RADAR when I read his dissent in FTC v. Midwest Recovery:
The FTC's go-it-alone debt collection enforcement strategy frequently leads to outcomes where victims receive only a miniscule percentage of their losses - or even nothing at all.
• To best serve the public and stop debt collection abuses, the FTC should work in concert with the Consumer Financial Protection Bureau. Joint actions will help make victims whole through access to the CFPB's Civil Penalty Fund and reduce duplicative efforts.
• As Commissioners, we must stop ignoring Congress and must recalibrate agency priorities and strategies in the financial services arena.

The issue here was the collection agency was able to settle their fine at .2%. This was a company that was parking fake debt to shake families down into settling just to make them go away.
There is a reason he is moving on and up. Dude gets it.

Does the CFPB have jurisdiction on these debt collectors? Looks like they were violating at least three laws, FDCPA, FCRA and UDAAP.

They can, but historically have held back. This appointment looks to give it teeth. As Chopra said, the FTC is ineffective alone and needs a united front with the CFPB to really put the screws to these collectors.

The CFPB and FCRA have some entanglement, certainly...but after some strong attacks years ago, they seem to be content trying to nickel and dime their way into technical violations that they can balloon into almost entirely pointless class action claims...

President Trump reportedly wants to create a third party once he leaves office.

According to a report Tuesday evening in the Wall Street Journal, citing “people familiar with the matter,” Mr. Trump has discussed creating a “Patriot Party.”

The discussions have happened with “several aides and other people close to him,” the Journal reported.
