I mean absolutely no disrespect when I say this, Shyster, but don't you think that people familiar with and deal with that type of law daily/regularly would have already come out with that analysis?

Probably, but I haven't seen it. I'd certainly like to see it, but I imagine those sorts of deliberations would be privileged. It's really just a pretty basic question of statutory interpretation. The question is whether the postpositive modifier applies to all of the elements in the series or whether it applies only to the last one. Section 19 of Reading Law: the Interpretation of Legal Texts by Bryan Garner and Antonin Scalia has a pretty good discussion on the issue. From what I can see no court has ever definitively ruled upon the topic, so anyone's analysis is pretty much as good as anyone else.

i don't understand the practical impact, though. does it afford the whistleblower fewer protections if he's not technically a legit whistle blower? or is this like a, "ha! gotcha. no impeachment because of this technicality!" thing.

I'm not sure there is a practical impact. Congress certainly isn't going to care whether the report technically wasn't a whistleblower report. It might only matter if there is some sort of adverse employment action for the person in question, in which case protections might only be available if the person actually was a whistleblower. For example, I've defended cases brought under a Pennsylvania whistleblower law, and I was able to get summary judgment on the basis that the person actually didn’t qualify as a "whistleblower" under the precise definition found in the statute, which meant that no protections applied to his termination and he was SOL.

1) A quid pro quo isn't needed to make the solicitation for a foreign contribution illegal.

2) The aid was approved in February, and delayed again in May; I think the Ukrainians were aware they hadn't gotten it yet.

I thought the aid wasn’t approved completely by congress until mid to late June?

It feels like the longer this plays out, the worse it is going to make the Democrats look. This is a very tenuous thing to be delivering articles of impeachment on. I'm guessing they are just trying to rush the sht out of it so they can add Trump to the "list of presidents to face impeachment" before 2020.
