Probably, but I haven't seen it. I'd certainly like to see it, but I imagine those sorts of deliberations would be privileged. It's really just a pretty basic question of statutory interpretation. The question is whether the postpositive modifier applies to all of the elements in the series or whether it applies only to the last one. Section 19 of Reading Law: the Interpretation of Legal Texts by Bryan Garner and Antonin Scalia has a pretty good discussion on the issue. From what I can see no court has ever definitively ruled upon the topic, so anyone's analysis is pretty much as good as anyone else.
