Are you asking where the SCTOUS came up with that test? I would imagine the same place they came up with strict scrutiny, intermediate scrutiny, and rational-basis review, i.e., they made it up.* The constitution doesn't say anything about specific standards of review, so it's always been up to the Court to determine what sort of standard of review would apply to the cases it hears.
* Specifically, the first time the SCOTUS mentioned the notion of differing levels of judicial scrutiny that would apply in different contexts was in Footnote 4 of United States v. Carolene Products Company, 304 U.S. 144 (1938).
