§ 2311. Restrictions on recreational spotlighting.
(a) Unlawful acts.--It is unlawful for any person to cast or
to assist any other person in casting the rays of a spotlight,
vehicle headlight or any other artificial light of any kind from
any vehicle, watercraft, airborne craft or any attachment to
such vehicles or crafts:
(1) Upon any building at any time.
(2) In any manner which frightens, excites or harasses
any livestock, poultry or other farm animal.
(3) To search for or locate for any purpose any game or
wildlife anywhere within this Commonwealth, other than
specified in paragraph (4), daily between the hours of 11
p.m. and sunrise on the following day.
(4) To search for or locate for any purpose any game or
wildlife anywhere within this Commonwealth at any time during
the antlered deer rifle season and during the antlerless deer
rifle season.
(5) Upon photoelectric cell lights.
The provisions of this subsection shall not apply if it is
proven that the headlights of a vehicle or conveyance were being
used while traveling on a roadway in the usual way.
(b) Penalty.--A violation of this section is a summary
offense of the fifth degree.

Summary Offense of the 5th Degree. Looks like prison time, mate.

TIL it's illegal to go spotting during hunting season in PA. Since I've never hunted, I was unaware of this. My dog loves to see deer, so I frequently take him for rides in the Jeep and tonight a Game Commission Officer pulled me over for illegal spotting. Apparently I'll get a citation in the mail with a fine of somewhere around $100-$300. I've never had so much as a traffic ticket before in my life so this is fun.

Those facts are thin. Were you using a light other than your headlights? There is an exception for using your headlights in a normal manner, but you couldn't be parked parallel to the road or anything.

Is there even a court date or is this a citation you can't contest?

As much as it sucks you're guilty af and I don't see a real easy way of getting you off of it. The officer should've had some better discretion but it's up to him really.

If there is a hearing just be respectful to the magistrate and beg for leniency. The problem being, of course, the court fees are probably the bulk of the citation and you won't be able to recover them.

Yeah, I was using a spotlight. I bought it after the time changed. I received the citation and plead not guilty. The hearing was scheduled for Jan 25 but they changed it to the 24th because the officer had a scheduling conflict. I have a photoshoot on the 24th so I called them today to see if it could be changed. Then the Judge recused herself. I think she might be on the board of directors for the Humane Society where I volunteer to take photos so I'm guessing that might be why. Not sure though. But now I'm waiting for them to transfer it to a new judge.

I really don't know how the heck someone who's never hunted is supposed to know a law that only pertains to hunting/poaching. I really think a warning would have been sufficient, but apparently I'm a scofflaw.

Yeah, like I said, discretion. This guy doesn't really have a very good grasp on it.

Either way, look at the breakdown between the actual citation penalty and the court cost. You would be fighting for the citation portion.

If you want you can just go to court and state your story and get it off your chest, that might be worth the $30 or whatever.

Oof, just looked and the fine is no less than $100 no greater than $200. That's stiff. Yeah, go fight it. Can't hurt.

My fellow legal types may be interested in this product. A new company called LegalBoard just introduced a computer keyboard "designed by lawyers for lawyers." It has a "legal mode" that uses the F keys and the number pad to permit a lawyer to insert common legal symbols and abbreviations and words (for example §, ¶, See, e.g., F.3d, Plaintiff, Appellant) and also do stuff like add footnotes and change spacing with one keystroke.
