If they prevail on the argument that President Trump was acting in his official capacity, that will effectively end the lawsuit. Federal government officers cannot be sued for defamation. But it looks like nearly all of the prior incidents they cite involve federal employees who were engaged in official conduct at the time. This alleged rape happened 20+ years ago, so I'm not sure how his response to it could be construed as official duty. (hehe, duty.....)

Now, Barr can play some venue charades, as well. But the story notes this is happening at a point in time where the civil case is nearing depositions. So this is more of a stalling tactic I think.

The way I understand it is exactly that - Trump said something during his presidency about this woman and that's how the defamation lawsuit began, IIRC.

I just don't think Trump should be able to use government funded support for personal cases. I think that's just wrong, completely.
